student with asylum seeker partner claiming Income support over summer

Hope you can help.

full-time student been advised by someone? that can claim IS over the summer period as a lone parent (3 children under 12) even though has a partner who is seeking asylum. Partner has no income though student has claimed adult dependents grant through student loan co for him.

Is this right?

I am not certain - but I think that the student would have to declare that she was co-habiting and make the claim as a couple. The asylum seeker does not have recourse to public funds. The fact that he has no income does not of itself allow the the student to claim to be a lone parent. Its very important that if a claim is made for any benefits that the claim is not construed as an attempt by the asylum seeker to get public funds. This could have an adverse effect on the claim for asylum. I suspect income support would treat them as a couple one of whom has does not have the right to claim public funds.
