Disability Premium paid while appealing PCA
Wed 10-Mar-10 01:02 PM

I hope this isn't a daft question.
I have a client who failed her PCA and so is claiming IS at the 80% appeal rate. However, since then she has been awarded DLA and so would be entitled to disability premium even if on JSA.
I know that on appeal rate IS you no longer get DP, but is this just if you have been entitled to it after being sick for a year? If, for example, someone was on high-rate care DLA and appealed a PCA decision would they lose their DP, SDP and EDP?
Thanks.

yes, in these circumstances she should still be getting the DP, so her weekly amount should be the DP plus 80% of £64.30
