i have just received my first refusal of IS under the new HRT. client is a swedish national, single parent. she is separated from husband, who is in somalia. she arrived in the uk jan 2004, and claimed in Feb 2004. this claim was refused on 13 may 2004. an appeal was lodged and is outstanding still.

new claim submitted in july, finally refused under right to reside. she has never worked in uk or sweden, and would not seem to neet any of the reqts as a qualified person.

has anybody had any success with this right to reside so far?
