I have a client who has been refused the Funeral Grant that he applied for in respect of his mother's funeral. He is the eldest son of a large family and accepted the responsibility of arranging the funeral. The reason that the grant was refused was because one of his brothers is working (though frequently on sick leave). The rest of the family are un-employed, though the eldest son is on long term sick with injury benefits. Is it advisable to appeal?

You could only appeal the decision if you are able to prove that the brother who is not in receipt of a qualifying benefit was estranged from his mother before her death. However, given that the grant has been refused based on the information given by your client on the application form then it is unlikely to win at Tribunal.
