Earnings from work and capital

My clients' are a couple, she is claiming pension credit for them both. They made the claim when he finished work through ill health and went on SSP.

He now is down to nil pay from work and believes they will finish him. He will then be entitled to approx £10,000 pay off. This is for time worked in lieu and holiday pay.

Question is how is this counted by pension credit ? Is it earnings from work or capital ?

If it is counted as earnings from work how does this affect the pension credit.

Have a look at chapter 39 of your Welfare Benefits and tax credits handbook for how payments from a job are counted for pension credit.

Would also suggest referring for employment and disability discrimination advice as your client might have a claim against the employer...

I've found what i think is the answer in chapter 36 of the CPAG handbook - page 936 onwards.

Funnily enough we dealt with this exact same question for someone today.

Very easy to do Tony - when i saw your posting i went to chap 39 to have a look as i was interested to see if i'd missed something - i read nearly the whole chapter before thinking you may have put a 9 intead of a 6!!!
