Mother of EEA worker, came to U.K to care for her daughter
Tue 26-Feb-08 08:50 AM

Help please.

Client is an established EEA worker who is now incapacitated. Mother came to U.K to look after her.

This is what I need help with. Can the mother get U.K. benefits as she is clearly not a dependent parent, though equally clearly she is a close family member of an EEA worker?

Hope this makes sense

Assuming Mother is an EEA national herself and both ready and willing to do a (not minimally) part-time job, she could become a carer-worker and claim benefits to top up part-time earnings.

thanks, as it happens the client is an A8 national so I suppose I'll have to advise her she needs to work. To make things more complicated it appears that she is already getting Carer's Allowance. So it appears that DWP have already accepted her R2R.

No, carer's allowance doesn't depend on R2R, only on not being subject to immigration control and no EEA national can be deemed subject to immigration control.

So simple, isn't it?

Thanks, like you say so simple. Sometimes our benefit system reminds me of a game from "It's a Knockout" with all sorts of bizarre obstructions and traps.
