I have a young mother with a disabled son entitled to DLA HRM & HRC. She was claiming IS & came in for a benefit check. I advised her to claim CA, which was successful. She has attended 2 back to work interviews (Oct 2005 & Oct 2006).I activated a claim for misdirection on her behalf & asked for the carers premium on her IS to be backdated, on the grounds that they did not give her full & accurate advice when she attended the back to work interviews. I argued that they were aware she had a disabled child & they should have advised her to claim CA at these interviews.
I have now had a reply from CA Unit, they say that they cannot find any document to support this claim for backdating from Oct 2005 to Nov 2006 & there is no right of appeal. Anything else I can do? Thanks Val.

Sorry didn't read letter properly, they are still looking at claim for incomplete advice & misdirection.
