How do your LAs deal with a change of circumstances when a claimant who is only in receipt of HB has a change of income that then brings them into CTB as well?
Assuming CTB was orginally assessed and refused at the same time that HB was awarded then it is not a supersession and a new claim is needed. But is the claimant required to complete a whole new claim form or a shortened form or just request in writing that when the HB is reviewed a claim for CTB is also considered?

A LA can accept a written claim in whatever form is chooses to - including insisting on a full claim form. However, "Novitskaya" will make it easier to argue at Tribunal that a letter was, and should be treated by the LA as, a claim.

LAs can also accept a telephone claim in whatever form it chooses. In our case we accept a telephone call where a claimant justs requests that they claim CTB and confirms the circumstances are the same used in the current HB claim. We record the telephone call.
