I have a client whose partner claims IS for them as a couple and she is now a F/T student and so advised to claim PC, as my client is 60+ anyway they heard nothing for nine weeks. I chased PC who has now located the claim as they initially said it had been lost. Anyway they now say that the claim for IS has to be withdrawn before they can even consider PC

My client is very worried as if cancels IS then waits for PC they will have no money is there no argument that PC should say take over the payments from a certain date. I also worry as the longer this goes on then there is another potential issue as PC ignores student income and IS does not, so overpaid it seems as IS although have been told of student status have not made any assessment to date of this and while this may be then non-recoverable as client has disclosed it would be desirable not to be in that position.

Any ideas and specifically reference to regulation, if there is one, would be more then welcome!
