Wasn't there a recent piece of case law allowing Permitted Work to be registed retrospectively?

Are you aware of the following. It was possible for a client to avoid being penalised by the DWP for undertaking therapeutic work (without having first obtained the DWP's consent to work), if it could be shown that the relevant work had been started on the specific advice of the client's doctor. The above provision was not included with the permitted work legislation introduced in 2002.

I am not aware of any recent case allowing retrospective consideration of permitted work. The wording of reg 17 social security (IFW) regs would seem to prevent such a decision.
