Carers Allowance and Full Time Education

Hi Jim

I have an appeal on this issue at the moment. I'm going to use CG/3189/2004 but the Department have put copies of CG/4385/2004 and CSB/1010/1989 both of which, ironically, may assist my arguments. My issue is, basically, how much home study time should be counted in. How about your case.

Wasn't aware of CG/4385/2004 and can't find a copy of it - DCS haven't included in their submission for my appeals. Could you forward me a copy? Thanks.

In my cases DCS have obtained evidence from the University that the supervised study is well above the 21 hours. One line I am going to argue is that little weight should be given to the evidence, as it is not clear as to how qualified the person is to answer the question. I am hoping to get evidence from the tutor of each student that will counter it.

That is, in essence, what my issue is. The college brochure gives a figure of what a student should do and the college principal has confirmed this but each tutor's actual allocation is a lot less. Furthermore, it was agreed verbally at an initial interview at which her father was present that the college would make concessions in her case because of her caring responsibilties. Thus the expectation is aspirational only. I am also waiting for the same evidence. Give me your fax number and I'll fax the decisions to you.

If there is any issue of the straddling of weeks, in terms of clocking up hours, CG/6/90 could be relevant.
