jurisdiction of tribunal for JSA sanctions
Thu 11-Feb-10 02:50 PM

Is anyone able to point me towards, or tell me, what scope the Tribunal has, if any, in relation to an appeal against JSA sanctions? eg are they able to find that the sanction imposed was unjust and that the client should be paid retrospectively for that period,

sorry, i can't find it in the JSA or TS rules.
many thanks
C

Yes, it's an appealable decision. The tribunal can find that the claimant had good/just cause for his action, and with a variable period sanction (eg for voluntary leaving) can alternatively if they find there was no good/just cause reduce (or exceptionally increase) the period of sanction.
Any decision about "good cause" is appealable on the basis that it isn't excluded.
