Claiming AA & DLA at the same time?

I would really like to get a final answer to this question, and so would all the other people at my work who do benefits advice!

Is it possible to be in receipt of AA and DLA at the same time, I have seen on another forum that it is, but still havent been able to find out how it works!

Also

I have a lady of 67 who was awarded indefinite HRM and LRC 10 years ago, she is at the point now where her care needs are a lot higher, but mobility hasnt changed. The BDC are insisting on a whole new DLA claim again. Is this right or is there something else I could be doing?

Apart from the difference in the qualifying time limits there would be no advantage in going for AA, even if it was permitted. The lowest rate of AA is identical in all respects to MRC in DLA, so if client already gets DLA it would be a case of superseding the DLA award, albeit with usual risks attached. regarding mobility

Am assuming you do not mean actually being paid AA on top of DLA. That would just be another urban myth.

The should send out a change of circumstances form which is divided into three parts. No need to return the mobility part if her mobility hasn't changed.

No, you cannot get AA as well as DLA. It is one of the criteria for AA that a person is not entitled to the care component of DLA (section 64(1) of the SSCBA). As the others have said, a DLA LRCC recipient who is 65 or over needs to apply for a supersession of the current DLA award in order to get the MRCC or HRCC (equivalent to lower rate AA or higher rate AA). It is not a new claim as such, but a request by your client to change an exisiting award on the basis that there has been a change in circumstances (an increase in her care needs).
