I've got a recovery from estate case where capital was held by deceased claimant on behalf of his daughter who had received it as compensation when 15. She no longer wanted it and so it was ditributed to other people on claimant's death.
Argument being it was never his so you cannot fail to disclose something that isn't yours. Idea is to get daughter to state all this at appeal or sworn beforehand.
