In the past, and now, youngsters in relevant education and in recipt of an EMA can claim Incapacity Benefit in Youth if they meet the requirements. Youngsters in work based learning and in receipt of a training allowance could not do this, presumably prevented by reg 4(1)(c)of the 1994 Incapacity Benefit regs which excludes people who are paid a training allowance.
Now that approved unwaged training has replaced work based learning, and EMA has replaced the training allowance, can trainees get IBY?
