Couple, him been on IB pre Oct 2008. She was working p/time below LEL, off sick since May this year but no SSP entitlement, on DLA m/care l/mob. There is undoubtedly some IS entitlement there, but he refuses to claim. She cannot claim IS as she was not incapable of work before Oct 2008. He also refuses to claim HB/CTB on low income grounds because he will not produce bank statements (obvious question - why?) and expects her to pay all the bills as she did when she was earning. Can she claim income related ESA for the couple even though he is on IB? I can't see anything in the books to say not, but can anybody confirm please?

That wouldn't get round the practical probelm of aggregation if he still refuses to produce evidence of his finances, which is the real reason for your query as I read it.
