NINO requirement after WIlson

Just started to come accross a few cases where the issue of meeting the NINO requirement for HB/CTB has come up with a partner from abroad. If a claimant's partner is in a similar position to Mrs Wilson in that they have not applied for a NINO on the inaccurate advice of solicitors etc is there anything to stop them simply applying for a NINO and asking for backdating on a new claim?

Also does anyone think that since the rules are contained in s1 of the SSAA which uses the term 'claim' in the sense of an initial application rather than a continuing claim that there might be milage in arguing that it does not apply in cases of supersession?

I'd be interested in any views on this.
