Social fund funeral costs

Has anyone heard of a client getting any help from the social fund to go to New Zealand to collect their fathers ashes as he died while visiting there???

No never heard of this - wouldn't it be cheaper and easier for the ashes to be shipped home on their own?

A few points - the funeral expenses regs:

do not cover transport costs outside the UK (Reg9(3)(d));

only covers "a burial or a cremation" (Reg 3(1)) and expressly does not cover the burial of ashes after a cremation (Reg 9(5)); and

because the cremation is the funeral for the purposes of the regualtions, and it was in New Zealand, it's excluded because the funeral must be within the EU.(Reg (7(9)
So not a lot of hope there, then.

hi

i went to tribunal testerday and have lost an appeal due to the regulation 7(9) and (10). My client went on holiday to spain with her husband and her husband died whilst they were there loking after their ill son. Client had to have the funerla there due to the 24 hour rule in spain. She had a cremation. This has cost her alot of money and she had to pay for all thi on her credit card.
Appeal was disallowed as chair stated client should have to satisfy reg7(9) and (10). Client is not a worker and her husband wasnt wither but could not the argument that client has the right to reside favour the argument under reg7(9)? te client and her husband have been living in the uk as british citizens for all their life? I think thi is unfair and the chair agreed with me but i need asstance as to the interpretation of reg 7 (9) and (10). Chair stated that the main issue was that the funeral did not take place in the UK under reg7(9)(b).
