10p safegard

Hello all

I understand from my information system that Income support have to leave you with at least 10p a week, if direct deductions are being made for debt or living expenses. Do Income support still have to leave at least 10p a week, if the dedcutions are for overpayments.

Yes - any deductions should be adjusted to leave the claimant with the 10p per week in payment. See the Decision Makers Guide Chapter 33 - 33318 which states the claimant should be left with at least 10p specified benefit after third party deductions have been made.

No deduction should be made if it would leave the claimant with less than 10p. But see Decision Makers Guide Chapter 33 - 33388 and 33423 for when the deduction may be adjusted instead of not being made.
