I have a client who has been refused Pension Credit because of the HRT although she has been here for 10 months or so. Luckily she has other pensions and DLA to live on in the meanwhile albeit £30 a week short. We have been appealing and submitting new claims but I am not sure of the right tactics here because of the way Pension Credit date of claim is considered. Should we be putting the date of claim as the date we submit the new claim or should we put the date of claim as our preferred date the claim which is the day after she returned to the UK from Jamaica?
