DLA Mobilty - over 65

Hi, I have a client who has been in receipt of middle rate DLA Care component only for a number of years with an indefinate award. They have recently been required to complete a review form which I assisted with, fortunately the care component has been retained following the review but Mobility Component at the high rate has also been awarded, even though my client is over 65.

I didnt think it could be awarded if they did not get it before their 65th birthday. Can anyone clarify for me please?

It is possible, on the periodic review, that info came to light that was entitled to the HRM and also from an earlier date and the DM decided to accpet it as a late request to look at the claim again. This would only work if client is in the pasy year 65?

I might be clutching at straws!

If you have an award of DLA care that was made before your 65th birthday, you can ask for a review or a supercession of that award to include the mobility component after age 65 providing you can show that you have satisfied the disability conditions for the mobility component since before the age of 65. Sch 1 para 1 SS(DLA) Regs.

When you completed the form you must have made it clear that there were mobility needs that started before the age of 65 so your client was awarded the mob comp.

Hi, thanks for your replies guys. I have checked the review form and I did state that clients mobility problems had started in 1996 which is prior to her 65th birthday. Therefore it does appear that the DM has accepted this and paid HRM accordingly.
