Can anyone offer further advise pls,
I have a Portuguese single parent who has been refused Income Support because she 'does not have the right to reside in the UK for benefit purposes only'. I was told by the DWP she fails the HRT because she is not working or seeking employment.
She was previously working but because homeless and as a result of that she lost her job. She is claiming CB and CTC. Any help will be appreciated.

Depending on the extent to which she was working she should count as a 'worker' under EU law and therefore would a) have a right to reside and b) be exempt from HRT

General enquiry whilst we're on the subject- has anyone won an HRT appeal since the new rules came in? We have a few cases which are likely to go that way and I'm having difficulty getting my head round how to successfully challenge them.
