Do we know if periods during which ESA is paid at the Assessment Phase rate pending an appeal against a WCA decision count towards the 28 week ESA entitlement that triggers entitlement to the Disability Element of WTC (and therefore WTC itself for many claimants).
And likewise can it count towards the 13 week entitlement required for eligibility for Return to Work Credit?
