I would like some help in this : 16 year old claimant still in special school and likely to stay there until 19th birthday. Mother in receipt of Income support. The mother (who is appointee) states she had a visiting officer to assist her to switch her daughters claim from dependant child to Incap claimant because she would be better off this is obviously not the case because mother would have claimed the full additions in Income Support or child tax credit.
Question is: Can we relinquish the Incap claim and revert to Child benefit and IS or Child Tax Credit? I believe it possible in that when Young people return to education the parents could re-claim but this has been in situations where the child had no entitlement to other benefits. I am not sure what happens when another benefit could remain in payment. Could that benefit be seen as notional income
