As far as I am aware it has not been possible to get the disability premium awarded for income support on the basis of getting a twelve month backdated medical cert from the doctor for many years.

However I have received a letter from another organisation saying they tried to get a disability premium on basis of 12 month backdated sick note in May 09, making me wonder if there has been a change and this is now possible again.

This is news to me. The issue of retrospective medical evidence was finally put to bed by CIS/2699/2002 and has not been opened up since, as far as I’m aware. See the commentary to schedule 2, paragraph (1)(b) of the IS Regs, top of page 552 of the current year’s law volume.

That should be CIS/2699/2001.
