DLA and intermitent care/mob needs

Hello, wonder if anyone can direct me. Client has bi-polar diagnosed 4 years, lots of medication, but suffers sereve anxiety and depression every 8 weeks which last 1-2 weeks. Probably entitled to lr mob and lr care during latter period but not necessarily during former. His partner recently awarded mr care and hr mob as she has a psychotic intermittent illness and bouts are more spread out tho last longer. Anyone know of any caselaw to support my client's case (if he has one)? Many thanks if you do.

Commentary which starts at page 136 of the Social Security Legislation 2004 (Bonner)Non means tested benefits, seems to alude to the problem you have with your client. Would your client be capable of keeping a diary so you can "add up" good and bad days?
