DLA unrecoverable overpayment appeal re eligibility

DLA have written to client she has been overpaid in error but they are electing not to recover?!

Has anyone come across criminal procedings in similar situations where DLA have acknowledged monies do not not have to be re-paid but none the less are subject to a criminal prosecution?

Client needs f.a.w.b.f + satisfies meal test + is in severe discomfort,

Any experiences gratefully received,

Now, I could be having a senior moment, or the question posed is not logical. If DLA have acknowledged that monies do not have to be repaid, then that clearly points to official error. If that is the case, then how can it none the less be the subject of a prosecution.

So, the purpose of the question is .....?
