Urgent caselaw for DLA appeal 27/10/09
Thu 22-Oct-09 09:58 AM

Caselaw for removal of a previous award (poss R(A)1/89)?

I need this for an upcoming appeal. Have googled, used the OCCS website etc and cannot locate it. I was given this caselaw on a Rightsnet blog under the subject of the removal or reduction in an award and how the previous awards medical evidence should be considered by the decision maker.

Thanks!

I don't have a copy sorry and if no-one else comes forward with one i'd suggest that you e-mail the OSSCSC and ask them to e-mail you it.

You should also look at R(M) 1/96, particularly paras 15-16.

We have got a hard copy of R(A) 1/89 in a bound HMSO publication. I can try to copy it and fax to you if that is OK. It is fairly brief

Thank you so much! I was losing hope as had posted this originally on the Disability section of the discussion board and no one relied!

You are a star!
