Pension Credit (& IS) for CHC cases in Homes

I have an elderly lady who is fully funded in a nursing home by the NHS under Continuing Health Care funding. She has just her SRP and a bit of tariff income from capital and is getting some Pension Credit. I think this is correct, but her appointee (son) is anxious, worrying that the 'all found' situation she's in is equivalent to income from the NHS.

In fairness of course, she doesn't really need PC at all, but I reckon she's just lucky. No doubt if they've got the sense not to give her an AIP, capital will grow and eventually tariff income will extinguish PC !

Am I right about current PC entitlement ?

Hi Jim,

I agree that SPS is payable as there is no provision for CHC to be treated as income.

I am at home so only have access to the regs and not sweet and maxwell, but I can not see any reason why an AIP can not be set. If she is selling a property for instance I think it is very clear that her retirement provision is likely to change in the next 12 months, but there is no provision for a DM to take into account the reduced amount of expences that she has by being CHC funded. What do you think?
