Failed PCA and claiming IS pending appeal.

Our local jobcentres are routinely telling clients who've failed the PCA that they have no other option than to claim ESA. As far as I can see there's still provision to claim reduced IS while awaiting appeal. Been on sick most of last 4 months. Did someone change this Income Support provision or repeal it recently?

And of course JSA (subject to the LMC's) is still an option also.

Got a client been told this - we've contacted JC+ and been told that he cannot get IS while appealing because he did not have an "income support element" in his Incapacity Benefit before it was stoped.

We asked to speak to someone higher and have been told the same.

I've now e-mailed the area manager and asked when Sch 1B para 24 & 25 was repealed - just waiting for a reply.
