A Man died, Hb want the money back but Partner remainging so has ongoing entitlement.
Have contacted Hb to aks they doe this but they have no replied and started recovering from bulk cheque.
I am fairly new at this, so any pointers welcome.

His partner needs to apply for HB with backdate. Good cause will be needed for backdate, but with the confusion and distress following a death that doesn't seem hard to argue.
The claimant can't really have ongoing entitlement when dead I suppose...so it will need the fresh claim.
Then they should take away the HB for the overpayment, and pay it back for the backdate.
It might even be possible to get them to just offset, not sure about that though particularly as the two claims will be in deifferent names.
Good luck, but I don't think it should actuaally take that much luck to get a full backdate in the partners name.

Reg 101(4) does not allow recovery from a remaining partner in such cases, what the HB dept have done is correct.
