I have a client in receipt of HB/CTB and the LA are deducting £7.40 from HB and ££2.30 from CTB for 18 year old daughter. She is in receipt of an allowance of £40.00 pw is studying full time at NVQ level 2. Reg 63(7) HB regs states 'no deduction shall be made .... c) he is a full-time student during a period of study within the meaning of Part V11 and is not a boarder. Part V11 defines this as "attendng a course of study at an educational establishment" of which further education colleges are listed in the annexe.
I don' think a NDD should be applied has any one got experience of successfully challanging this.

If the daughter is getting £40 pw training allowance, I'd guess she's "in receipt of a training allowance paid in connection with a Youth Training Scheme, etc" - reg 63(7)(b). That's also a nil deduction, of course. CTB Reg is 52(7)(b).
