Suspension / Cancellation of HB

Our Council is in the habit of cancelling benefit if the tenant has not been in for two notified visits. They claim to be acting under the HB DMA regs 11 and 14. However they didn't make a specific information request, and the Judge in CH/2271/2009 http://www.rightsnet.org.uk/pdfs/CH_2271_2009.pdf said that this was clearly wrong

LAs in my experience are lousy at following the procedures for suspending and terminating awards for failure to give information, and tribunals and even more so commissioners (especially Richard Poynter) get very cross with them. I think I have posted on this site before about the PO who referred to the regulations (at tribunal) as "guidelines"....
