I have an appeal pending over a number of issues relating to the date of claim for JSA. My client was on JSA and moved to a different area – does his new claim interview in his new town actually count as a “new” claim?
Unfortunately he was late for two successive appointments at the jobcentre and each time they refused to see him. I note that 25(1)(b) of the JSA regs refers to:
“…SoS has informed that clamant in writing that a failure to attend, on the next occasion on which he is required to attend, at the time specified in such a notification may result in his entitlement… ceasing”
Is there any guidance or case law which sets boundaries about how late a claimant must be for an appointment for them to be regarded as having failed to attend at the specified time?
