Mums award threatened at daughters appeal
Thu 15-Nov-07 03:01 PM

The daughter has an autistic spectrum disorder - some med evidence held to support middle rate care. Currently on low rate. Mum is main carer. Went to appeal without a representative and appeal adjourned to get advice because Chair decided that her level of benefits were not compatable with caring for her daughter.

Should she be advised to withdraw? Is there any case law / protocol surrounding a tribunals right to look at Mums benefit when appela is not about her?

A little more detail would enable us to get a better picture -

what degree of Autism are you talking about?
Is Mum an appointee for her daughter?
I assume Mum is receiving disability Benefits herself?
Did the chair feel that mum's disabilities would preclude her from being a carer?

Even just on the brief details you've given up to now, I can't see a connection between an appeal against the refusal of an award of middle rate for her daughter and her own benefit situation...what would he suggest, she stop caring for her daughter....!

If you're not too sure about putting too much detail on here, you can always contact us direct, us being neighbours etc ....
