Council Tax Discounts/Exemption on the basis of Severe Mental Impairment

I know Incapacity Benefit is a qualifying benefit for above, errrrrrrrrr howz about IB credits, i think i'm not so much clutching at straws, as desperately trying to find one, but want to be told yes!

Errrrrrrrrr anyone got any thoughts,advice or ideas?

I think underlying entitlement is enough. CPAG Council Tax Handbook p95 refers.

Difficult to be sure as the Regs (CT Discount Disregards Order 1992 SI No 548) have been amended frequently and I can't find a consolidated version, but I can't find any mention if incapacity credits alone as being a qualifying benefit. IB, IS or JSA with DP, SDA, AA, DLA MRCC and disability element in WTC will all do, but not incapacity credits. Unusual to find someone who can get a GP certificate as SMI but doesn't get one or another of these though.

Thanks Brian, thanks Richard.

Haven't a copy of the CPAG council Tax handbook, any more info on underlying entitlement would be really appreciated?

Client's partner (mild learning disability) works full time ruling out IS/JSA, she's in mid 20's can't fit her into YPIB.

Her DLA award is LRC/LRM, client is learning disabled (speech and language deficits) to the point she cannot retain or follow simple info or instructions, needs constant reminding/prompting. Had a brief job in the tiny local tea shop in the village she lived at, but found it to challenging to take orders e.g. cream teas and remember who ordered what etc.

Client and partner overjoyed that she was awarded LRM/LRC DLA, are not in the least bit interested in challenging decision in favour of award of MRC, which she does appear to have a case for.

Hence plan B, hoping such a thing as underlying entitlement exists.
