I've got a Tribunal coming up for a Pension Credit appeal. Parents have come to the UK to live with their EU worker son and we are saying that they have the right to reside as they are dependent relatives. There seems no doubt that the parents are dependent on their son and his wife- they live with him, he buys all the food, he cares for them etc. Does anyone know of any case law that I can use to back up the dependent relative argument? I'm just a bit nervous about the Tribunal saying that they are only dependent because they have moved to the UK and would otherwise not be dependent.
