Tnt on I.S. She has 2 children aged 13 & 18. She states she is getting CB for both children, she was receiving full HB/CTB due to I.S

18 year old at college, and due to return in Sept 08. She recieves EMA but has recently started working part time for a bit of extra money.

HB have re-assessed tnt's claim and set a NDD at £7.40 pw...

However, I thought if the tnt is still receiving Child Ben for the daughter, then a NDD would not be applicable.. Read CPAG and this states that she would be classed as dependant if CB is still being receivied and dependant's income does not affect HB...

Can someone tell me im right please...

of course you are right -if she is she in receipt of Child Benefit for the 18 year old, she can not be treated as a non-dependant. I presume that she is in further education not higher education as a non-dep charge could apply to a full time student who worhs in the summer vacation. However she would not be getting Child Benefit for a higher ed student anyway.
You therefore appear to completely correct in your argument -therefore you must contact the HB dept in writng pointing out their error.
