IS and housing costs
Mon 10-May-04 03:04 PM

I have a lady in receipt of IS and DLA, who lives alone and is renting her house from her mother. She receives Housing Benefit. Her mother is thinking of selling the house to her. Client wants to know if she can receive housing costs. Looking at IS (General) Regs 1987, Sch.3 para.4(8), it seems as though she can, but I wanted to check if there was anything else I should be aware of, before she makes the decision (assuming, of course, that she can get a mortgage).
Any thoughts?

If she has alrady been on IS for more than 39 weeks she wont have to wait, but dont forget that her housing costs will be restricted to the amount she was getting in housing benefit
