Have a client of 61 years old who was refused Employment & Support Allowance and then went on to appeal that decision, he is paid the appropriate rate of £64.30 ESA while he is appealing. Shortly after he appealed the ESA he claimed Pension Credit and secured that. Read previously in the discussion forum that with incapacity benefit if someone is eligible to Incapacity Benefit and claims Pension Credit it would be in his interest to continue the claim of the IB otherwise the Pension Service could consider the IB as notional income.
With ESA (contribution based) & Pension Credit could the same risk apply that if ESA is not claimed (e.g. from continuance from SSP) could it be considered as notional income, and in his case would there be any risks now he has embarked on the ESA appeal to discontinue it as the difference in his income ought to be made up by additional pension credit.
