Making a new claim for ESA more than six months after being refused.

Hi

I have a client who had her ESA removed over six months ago. We put a GL24 in but she does not want to have an oral hearing because of the stress involved and a paper hearing is unlikely to suceed.

I know she can put in a new claim now and she will be treated as if she is in the first week of the assessment phase.

However, is she likely to face a work capability assesment soon? (I understand that this would normally take place after 13 weeks but the department has the discretion for it to take place sooner). The client would also find a work capability assessment stressful.
