Incapacity Benefit Appeals and Pension Credit

We have had a few cases calling into our office recently - all men in their early 60s who have failed to satisfy PCAs and have been advised by the local JC Plus office not to appeal the decision - but to claim Pension Credit. All are on the long term rate of Incapacity Benefit £74.15. The clients in question are single so the rate of Pension Credit is greater at £105.45. I have checked with the Contribution Centre, Pension Centre and the relevant regs which all indicate that a credit is paid for every week they claim Pension Credit. All have no occupational pensions or savings.
Any reasons why these clients should continue with an appeal?

I am glad to see that the Path Ways to work pilot is also going very well in your area.
Similarly as when the Incapacity claimants numbers were reduced when Invalidity Benefit changed to Incapacity and the claiming age was reduced to 65 instead of 70 for men I feel this is now being done more subtly. OK there is more protection but it still does not make it justified.
As for appealing if people feel strongly that their condition should be recognised as making them incapacitated I feel they have that right. But maybe we should agree to be more pragmatic and save the tax payers money ?

If as you say they all had £74 Incapacity they should all have had PC anyways?

I would advise appealling always.

Rememebr PC is means tested IB is not.

What if they get married to someone working full time?

If they win the lottery or come into money?

If a new partner had Pension Income over their applicable amounts?

PC would stop, IB would still be payable though.
