1997 IS o/p...?

I saw a cli. this morning... She is on Incap (applied DLA), I htink she is entitled to IS... She is getting £72 per fortnight ICB, sue to an o/p if IS, she believes accrued 1997..?

It does not sound right they are able to do this with the limitations act..

The are taking £25 per week form her award.

She is not literate and suffers from depression. She says she does not open her post..

Any thoughts before I contact them.. I need to at least get the repayment amount lowered to a more reasonable rate, but wonder if I have grounds (maybe other than) the limitations act to stop them collecting at all...

Limitation act would only be relevant depending on the date they first started collecting this money. and then only if it's a common law recovery, whcih is what the limitation act applies to. you'd need to see all the paperwork......and won't be able to have thoughts on the case until you have it, i don't think.

So what exactly should I ask them for and can I ask them to cease recovery whilst looking into this or at least reducing..
