Child Support qualifying age

My client has a daughter who turned 18 in April 2009 and is taking an extra year to complete her A levels at a further education college (12 hrs or more per week). She will be 19 in April 2010 and finishes school in June 2010 - at what date should client's child support payments stop? (case is 'old rules') Client unaware if CB still being paid
Any help on this would be much appreciated - I have limited knowledge of CSA and finding legislation somewhat confusing! many thanks

I think that she only counts as a 'qualifying child' until the age of 18 if she is in full-time non-advanced education, therefore the child support payments should stop when she turns 19. See p.18 of CPAG child support handbook 08/09.

However, the Child Maintenance and Other Payments Act 2008, has a clause, s.42, that extends the definition of a 'qualifying child' to no more than 20 years, in line with child benefit entitlement - I don't know if this section has been enacted yet. I have called someone at CMEC to try and verify this so will let you know if and when I find out anything.

Ok, checked it out and s.42 hasn't been enacted as yet, so 18 remains the upper age limit as far as I can see.
