Crisis loans and right to reside / immigration control

I have several clients who are EEA nationals with pending IS/JSA claims, where the application was made weeks/months ago but no decision has yet been made about whether they satisfy the HRT. They have been told by the Jobcentre that they are not eligible for Crisis Loans, but am I correct in thinking that because they are EEA nationals they do not count as 'subject to immigration control' and are not excluded from applying for Crisis Loans? (CPAG handbook pg 1375 suggests this).

Just spoke to CPAG who confirmed that this understanding is correct, there is no residence requirement for Crisis Loans and EEA nationals are not 'subject to immigration control' so cannot be excluded from applying, although there may be issues about whether they could ever repay the loan if their right to reside has not been confirmed.
