I have a client who is going to appeal next week
for an overpayment of ICB from the mid 1990s
my client was doing Councillor duties during this time
there was a claim for overpayment of DLA High mobility
and care component this has now been resolved and the commissioner
has stated that High mobility was correct but took away the care
this decision was last week (and a paper review)
she has no one to represent her at the tribunal (i am too far away)
what if any help can she get? the hearing is in Chesterfield
what cases could she quote?
will the decision for DLA help her case?

Contributions & Benefits Act (171D & 171F) and Incapacity for Work regs 10A, 16 & 17 should apply- work as a local councillor is allowed. Can't recall that the situation was any different in the mid 90's. Was she doing some other sort of work at the time?
