Failure to attend Medical Examinations
Thu 17-Nov-05 02:40 PM

Has anyone any ideas and/or caselaw references concerning where someone fails to attend a medical examination because of a genuine mistake about the date?

I am currently working on an appeal where the client wrongly noted the date of the medical as 16th of the month when it was actually the day before. She only realised the mistake on the morning of 16th when she got the letter out again to check the location of the venue. This was a one-off occurrence and the person contacted Medical Services and DWP immediately to explain the circumstances. DWP stopped her benefit on grounds of failure to attend the medical.

There's a thread just a bit further down the page, started by Chris Parks, about this. slightly different but may be some use to you.
