IB and occupation sick pay after 196 days
Tue 19-Apr-05 10:17 AM

A cl who has been on sick leave since 2 may 2004. She recived full pay for six mths (offseyt against SSP) then half apy for six mths. This may be a rather basic question but is the occupation sick pay, paid as half pay for second six mtyh when she was entitled to IB treated the same as an occupation pension?

According to Disability Rights Handbook -

"Pension payments that are subject to the reduction are periodical payments under:

a personal pension scheme
an occupational or public service pension scheme
a permanent health insurance scheme arranged by a former employer."

and " IB is not affected if you receive wages or sick pay.."

Hope this helps

Just to confirm, yes Incapacity benefit can be paid in addition to occupational sick pay (and Incapacity benefit will not be reduced becuase of it).

....but it is not uncommon for contracts of employment to specify that your OSP will be reduced by the amount of any ICB you receive.

I've got a similar case;client has had full pay for 3 months and 3 months half pay and was given bad advice by Unison rep i.e. that she can't claim Incapacity Benefit and associated premiums(is etc), does this mean that she can get her IB backdated because of bad advice!!!!!Would the DWP play ball? Thoughts appreciated my fellow man(woman)thank you
