Single parent not entitled to TCs...?

Hi All,

Following my previous post about this client:

She is a single parent and on IS - she is only receiving £75 pf IS due to deductions. I have asked DWP to reduce these due to hardship. She also informs me that she is not reciving TCs...

Due to the stupid length of time it takes HMRC to respond to us, I contacted her MP and asked him to intervene about why she is not receiving any TCs - assuming at that stage that they were recovering an o/p at 100%...

Anyhoo.. HMRC resonded to the MP and siad...

"After furtehr investigation, I can see that we are not recovering the o/p from Ms S's award at this moment in time. Ms S's payments have stopped as she has already received her full entitlement for the 2009/2010 financial year. This is because her entitlement has reduced. Depending on her circumstances Ms S will not receive any furtehr payments until April 2010 when her new award starts."

How can they leave a single parent below the poverty line in this way - is this correct - what can I do... I have written again to them.. but expect a response around Septmber...!!

Just to ask what happened with the Overpayment of HB ? Has it been taken off ?

No reply from the benefits unit as yet.. Not expecting a positive response to my write off request, but I live in hope.. x

have HMRC calculated her T/Credits correctly? specifically for the period of time during this tax year that she has been receiving IS she should not experience reduction in her Tax Credits because of taxable income for those relevent periods
