My client works as a s/e glazer for a company and his contract ended on 19/02/10 when work dried up. He claimed JSA soon after and was refused because the break was part of his normal trading.

I have checked the Regs and is my only hope of requesting a review on JSA 1996/207 reg 95 (b) - "there has been a change which is liekly to affect the normal pattern of business...enable the weekly amount ...to be determined more accurately" ??

I have until 13/05/10 to put in a review.

Any help would be appreciated

hi joannah

attached link to briefcase summary of R(JSA) 1/09. this sets out questions a decision maker should address in these circs.

first argument might be that client is no longer in 'remunerative work' because he is no longer trading as self employed person. you could perhaps argue, depending on circs, that his self employment was very much linked to his contract with company and that it stopped when the contract ended so that he is now unemployed.
